Why do we have to mediate our Tampa family law case?

Tampa Bay area Family Court Judges require parties mediate their cases prior to being able to proceed to a final hearing.  This is extremely frustrating for the parties and their Tampa divorce attorney, but is unfortunately a requirement.  As I have told many individuals, mediation provides several significant benefits:

  1. It permits your Tampa Family Law Attorney to observe the opposing party’s expectations and settlement positions;
  2. It requires the Tampa Family Law Attorneys to meet face-to-face to begin to flesh out the issues that will likely have to be resolved at a final hearing;
  3. Mediation also permits the parties become somewhat more realistic about their expectations during the proceedings;  and
  4. Mediation serves to deescalate the previous emotional tension between the parties.  Many times, this is the first time the two parties have seen one another since they initially separated and this will also often deescalate a lot of the emotional frustrations between the parties.
