Anyone that has conducted any sort of internet research regarding their Tampa criminal defense matter or a driving under the influence charge has ultimately come across the term pretrial intervention or misdemeanor intervention program. It is worth noting, though, that currently in the Tampa Bay area, these diversion programs are not offered in driving under the influence matters. It is worth noting, though, that some larger urban circuits are permitting folks to attend diversion programs for DUI arrests elsewhere in Florida, such as Miami-Dade County. We believe that eventually this program will extend to the Tampa Bay area, but is not currently available.
This is obviously unfortunate for folks in the Tampa Bay area because the DUI charge will inevitably stay on their record forever, but unfortunately, it is the current state of affairs. It is worth noting though that our Tampa DUI attorneys have had great success getting these charges reduced to Reckless Driving. It also worth noting that a DUI charge is one of only a few charges which cannot be expunged or sealed pursuant to Florida law.
