First DUI
Fine – Minimum of $500 – Maximum of $1,000
Fine (if BAC is above .15) – Minimum of $1,000 – Maximum of $2,000
Probation – Minimum of One Day – Maximum of One Year
Time in Jail – Minimum of One Day – Maximum of Six Months
Time in Jail (if BAC is above .15) – Minimum of One Day – Maximum of Nine Months
Ignition Interlock – Not Required – Six Months
License Suspension – Six Months – 1 Year
Vehicle Impound – 10 Days – 10 Days
Other Penalties -50 Hours of Community Service (a portion can be bought out at $10 an hour in Hillsborough County generally). Many Judges in Hillsborough County will require three (3) of the hours to be performed in a Victim Impact Panel and Successful completion of DUI school and Substance Abuse Evaluation and any recommended treatment.
Second DUI Conviction Within Five Years of First Conviction
Fine – Minimum – $1,000 – Maximum – $2,000
Fine (if BAC over .15 or minor in car) – Minimum – $2,000 – Maximum – $4,000
Probation – Minimum – 1 day – Maximum – 1 year
Jail Time – Minimum – 10 days – Maximum – 9 Months
Jail Time (if BAC over .15 or minor in car) – Maximum – 10 days – Maximum – 12 Months
License Suspension – Five Years – Five Years
Impoundment – 10 Days – 30 Days if Second DUI Within 3 years
Ignition Interlock Device – 1 year – 1 year
Other – Completion of DUI School and completion of Substance Abuse Evaluation and completion of any recommended treatment
SECOND DUI CONVICTION OUTSIDE FIVE YEARS OF FIRST CONVICTION
Fine – Minimum – $1,000 – Maximum – $2,000
Fine (if BAC over .15 or minor in car) – Minimum – $2,000 – Maximum – $4,000
Probation – Six Months – 1 Year
Jail Time – 1 Day – Nine Months
Jail Time (if BAC over .15 or minor in car) – 1 Day – 12 Months
License Suspension – Six Months – 1 Year
Impoundment – 10 Day Period – 10 Day Period
Ignition Interlock Device – 1 Year – 1 Year
Other – Completion of Approved DUI School and successfully Complete Substance Abuse Evaluation and any treatment recommended.
THIRD DUI WITHIN TEN YEARS OF FIRST DUI CONVICTION
Fine – Minimum – $1,000 – Maximum – $5,000
Fine (if BAC greater than .15 or a minor in vehicle) – Minimum – $4,000 – Maximum – $5,000
Probation – 1 Day – 1 Year
Jail Time – 30 Days – 12 Months
Jail Time (If BAC greater than .15 or a minor in vehicle) – 30 Days – 12 Months
License Suspension – 10 Years – 10 Years
Impoundment – 10 Days – 90 Days (If Third DUI within 5 Years)
Ignition Interlock Device – Minimum of Two Years – Minimum of Two Years
Other -Completion of approved DUI School and successfully complete Substance Evaluation and any recommended treatment.
FOURTH DUI CHARGED AS A MISDEMEANOR
Fine – Minimum – $1,000 – Maximum – $2,500
Fine (if BAC over .15 or minor in the vehicle) – Minimum – $2,000 – Maximum – $5,000
Probation – 1 Day – 1 Year
Jail Time – 1 Day – 1 Year
Jail Time (if BAC over .15 or a minor in the car) – 1 Day – 1 Year
License Suspension – Life – Life
Impoundment – 10 days – 10 days
Ignition Interlock Device – At Least 2 Years – At Least 2 Years
Other: – Completion of DUI School and successfully Complete Substance Abuse Evaluation and any recommended treatment.
FOURTH DUI CHARGED AS A FELONY
Fine – Minimum – $1,000 – Maximum – $5,000
Fine (If BAC over .15 or minor in vehicle) – Minimum – $1,000 – Maximum – $5,000
Probation – 1 Day – 5 Years
Jail Time – 1 Day – 5 Years
Jail Time (If BAC over .15 or minor in vehicle) – 1 Day – 5 Years
License Suspension – Life – Life
Impoundment – 10 Days – 10 Days
Ignition Interlock Device – Minimum – 2 Years – Minimum – 2 Years\
Other: – Completion of DUI School and successfully Completion of Substance Abuse Evaluation and any recommended Treatment.
