Anyone that has been in anyway related to any divorce cases, knows that one of the most frequent concerns and complaints about spouses is that the other spouse is hiding money. In our experience, these are the most efficient and effective ways to find and identify available assets for equitable distribution.

First, we utilize depositions and other forms of written discovery to begin the process to identify potential financial areas and financial institutions, where these assets may be found. Further, during these depositions we can ask about the transfer of assets to and from family members, new boyfriends/girlfriends, and other individuals, who simply may be holding money. Further, it’s also necessary to inquire about whether they have given a substantial trust retainer to their attorney in an attempt to hide or misappropriate marital assets during their Tampa divorce.

Secondly, we use either an investigator and/or a forensic accountant to begin analyzing bank statements and other financial affidavits filed by other party pursuant to the rules of Florida family law. Once the analysis of these records is complete by the investigator and/or forensic accountant, we can then conduct further directed discovery at these financial institutions, including subpoenas, depositions, subpoena duces tecum, etc.  We can also “cold” subpoena financial institutions near your marital home to identify hidden accounts.  This is called “cold” because we are essentially blindly looking for accounts.

In our experience, the most efficient way to begin the process of identifying hidden assets is to start with the person and then work our way to those potential financial institutions. Obviously, if your situation requires another strategy, we can utilize our experience and aggressive nature to go out and find an aggressive way to find those records and assets.
