After this trial, many folks were concerned about can a jury question witnesses. While the Jodi Arias trial has captured the attention of the nation, it has certainly not reached the level of national hysteria of the Casey Anthony trial. One of the most telling moments of trial occurred when the jury asked Arias over hundred question concerning her recounting of the events leading up to the alleged murder. Given the frequency and content of the questions, it appears the Jury had some serious doubts concerning Arias’s credibility and veracity during her testimony.

In Florida, whether the jury is permitted to ask questions of witnesses depends judge by judge. Ultimately, the judge determines whether the questions are permitted to go to the witness. The overwhelming majority of judges do not even ask the members of the jury whether they have questions. This method is favored by the overwhelming majority of trial attorneys as well.

If the judge permits the jury to pose questions to witnesses, the jury will write the questions down on pieces of paper. The paper is transmitted to the bailiffs, who then provide them to the judge to pose the question. Needless to say, there are few moments as terrifying from criminal attorneys as when jurors pose questions to witnesses. It is often effective for learning exactly what the jury is interested in and where they believe the case is headed.
