To Blow or Not to Blow, that is the Question…

This is arguably the most commonly asked question to Florida criminal defense attorney. Generally the question sound something like this “hypothetically, if I get pulled over should I blow or not?” The short answer to this question is it depends on the facts of this case. The decision as to whether take a breathalyzer test is important unfortunately does not warrant a one size fits all response. It is impossible for Tampa criminal defense attorneys to answer that question without knowing the circumstances of why you were pulled over, the basis of the arresting cop’s suspicion that you were driving under the influence and other relevant factors. The simple fact is the circumstances of your arrest dictate the recommended course of action for the case.

The Florida Department of Law Enforcement oversees the maintenance of breath test machines in Florida.  The Program is entitled the “Alcohol Testing Program.”  This program isn’t without controversy, recently the director of the program was forced to resign after it was discovered maintenance wasn’t properly being completed and maintenance logs were being improperly maintained.
